I. Information and access to personal data

This website, hereinafter referred to as "Website", is a service provided by Kancelaria Adwokacka adwokat Jarosław Grabias, hereinafter referred to as "Grabias Law Firm", a law firm offering comprehensive legal services, with its offices and registered addresses in Warsaw and Krosno. Personal data is processed by Grabias Law Firm which is the Personal Data Controller within the meaning of the Personal Data Protection Act of 10 May 2018 (Journal of Laws of 2018, item 1000 and 1669).

Your personal data will be processed in accordance with the Polish Personal Data Protection Act (indicated above) and other applicable laws and regulations.

Purposes of data processing, legal basis and legitimate interests pursued by Grabias Law Firm

Your personal data are processed for the following purposes: providing legal advisory services as well as establishment and exercise of legal claims or defending against claims related to your contract or provided legal advisory services.

Personal data will be processed in order to fulfill the statutory obligation resulting from the Act of 26 May 1982 on bar association (Journal of Laws of 2018, item 1184, as amended) and other legal acts related to undertaking activities in the provision of the legal service. Necessity of the personal data processing for the performance of a contract, including data storage for archival purposes and ensuring accountability, proving that the Grabias Law Firm fulfills its obligations arising from the legal provisions. Furthermore, a legitimate interest of the Data Controller is the ability to claim. 

Recipients of data

Your personal data may be made available to entities and bodies to which the Data Controller is obliged or authorized to disclose your personal data on the basis of generally applicable laws (including courts and state authorities).

In addition, your personal data may be transferred to entities that process personal data at the request of the Data Controller, including service providers, business information offices, data processors for debt collection – these entities process data on the basis of an agreement with the Data Controller and only in accordance with his instructions.

The period of data storage

Your personal data will be stored until the claims for the contract or service are limited or until the obligation to store data resulting from legal provisions expires, in particular the obligation to keep accounting documents regarding the contract, in particular the obligation to store data obtained for the purpose of financial security measures.

Personal data will be stored for the period necessary to terminate civil claims.

If we process personal data based on the Data Controller’s legitimate interest, personal data will not be processed for a particular purpose if you object to such processing, unless we demonstrate important legitimate grounds for processing, overriding your interests, rights and freedoms or grounds to establish, investigate or defend against claims.

Rights of Interested Party

You have the right to access your personal data, correct them (correct, supplement), limit their processing or removal.

To the extent that your personal data are processed in order to perform the contract or provision of services or processed on the basis of your consent, you also have the right to transfer your personal data. In this case, you will receive from us your personal data in a structured, commonly used format, readable by machine. If you have agreed to any activities related to the processing of your personal data you may withdraw your consent at any time. The existence of the right to withdraw consent at any time shall not affect the lawfulness of processing based on consent before its withdrawal. 

You have the right to object to the processing of your personal data when processing is based on a legitimate interest or for statistical purposes, and the opposition is justified by your particular situation. After the receipt of the objection, we will no longer process your data for the purpose or purposes of which you have expressed objection, unless we demonstrate important legitimate grounds for processing that override your interests, rights and freedoms or grounds to establish an investigation or defend your claims.

You also have the right to lodge a complaint with the supervisory body dealing with the protection of personal data.

Information about the requirement or voluntary data submission and the consequences of failure to provide such data

Providing personal data is voluntary however necessary to conclude and performance of the legal advisory.

Transfer of personal data outside the European Economic Area

Your personal data will not be transferred outside the European Economic Area, hereinafter referred to as "EEA". If it is necessary to transfer data outside the EEA, the data will be transferred on the basis of appropriate legal safeguards, which are standard clauses of personal data protection, approved by the European Commission.

All of your rights described above may be limited by the duties and interests of the Data Controller, resulting from the provisions of the generally applicable regulations protecting legal interest of an imperative nature, that override your interests, referring to the protection of the personal data.
